INTRODUCTION

 

These Terms and Conditions are made between AR Interiors Inc (“we”, “us” or “our”) and you, the individual or business choosing to use our services. Your use of our Services is conditional on you complying with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service. Please read the Terms carefully before using the Service. AR Interiors Inc is a design studio that provides full service interior design services. AR Interiors Inc also offers downloadable Online Home Designs. Our Online Home Design includes a number of tips and tricks and other “Bonus Materials”.

 

REFUND POLICY

 

Unless otherwise specified all purchases made from the AR Interiors website are non refundable.

Please be certain that the Service or Online Home Design you have selected suits your needs as all sales are final. We strongly recommend that you send us a message with any questions you may have prior to purchasing. You can reach us at info@arinteriors.ca. We will respond during our regular business hours (Monday-Friday, 9:00am-5:00pm PST and closed for recognized statutory holidays in Canada).

Please note, AR Interiors Inc. reserves the right to change prices without notice. 

 

SHIPPING POLICY

 

Our Online Home Designs and any guides sold or free on our website, are conveniently delivered straight to your inbox, eliminating the need for shipping. The in person consultation/meetings we offer are in person or over zoom. No shipping is required for any of our services or digital products. 

 

ONLINE HOME DESIGN AVAILABILITY

 

We cannot give any assurance that any particular Online Home Design will be available or remain available for purchase. As mentioned, we only release a limited number of downloads, and all sales are on a first-come-first-served basis. You know what they say, the early bird catches the worm!

  

PLEASE NOTE

 

Where you visit, register and/or subscribe to AR Interiors Inc, these Terms will be governed by the laws of British Columbia and will operate as between AR Interiors Inc and you, to the maximum extent permissible under the law of the territory that you are located in.

 

ACCEPTANCE OF THESE TERMS AND CONDITIONS

 

We know Terms and Conditions are about the most boring thing to read through, however, by purchasing any of our services or Online Home Design, or using or accessing our Bonus Materials, it is implied that you agree to comply and be legally bound by the terms set out in this agreement, which is why you should really take the time to read all the terms and conditions. While you’re at it, you should also head over to check out our Privacy Policy as well. 

 

CHANGES TO TERMS

 

From time to time, we may need to make changes to these Terms and Conditions  and may do so at any time. The date at the top of these Terms and Conditions represents when it was last revised. If we make a change to any terms that we believe in our discretion materially affects the way our services apply to you, we will notify you in advance on our website. It is important to check these Terms and Conditions  from time to time to ensure that you are all caught up to date. By continuing to access or use our services after a change has occurred, you agree to be bound by our updated Terms and Conditions. 

   

DEFINITIONS

 

  1. “You/Your” means (as appropriate) the Visitor, Registered User and/or Subscriber accessing the Service.
  2. “Intellectual Property” means copyright, trademarks, database rights and/or any other intellectual property rights as recognized in any jurisdiction.
  3. “Content” means all material, data, articles, information and products available on the AR Interiors Inc Website or provided as part of the Service. 

 

INTELLECTUAL PROPERTY

 

  1. All rights in and to the Online Home Design including all original content will remain the exclusive property of AR Interiors Inc and its licensors.
  2. The Online Home Design and all contents thereto are the original work of AR Interiors Inc and are protected by copyright, trademark and other laws of both Canada and foreign countries. Our trademarks and trade address may not be used in connection with any product or service without the prior written consent of AR Interiors Inc.
  3. You may use the Online Home Design and Service solely for your personal use and benefit and not for resale or other transfer or disposition to any other person or entity. You may not use, reproduce, modify, transfer, exploit, distribute or dispose of any Online Home Design for any commercial purposes, whether direct or indirect, in any manner that might compete with our business. 
  4. Save for where provided otherwise in these Terms, distributing, sharing, copying, posting, scanning, forwarding, selling, publishing, retransmitting or otherwise providing access to any part of the Online Home Design to anyone without our express prior written permission, is not authorized and may be a violation of national copyright laws.
  5. Any request for permission to republish, reprint or use any articles from any of the Service or our trademarks for any purpose other than those permitted under this Clause 3 should be sent to info@arinteriors.ca
  6. When reposting AR Interiors Inc content whether on Instagram, Facebook or any other form of social media or print media, for promotional purposes, you must credit AR Interiors Inc by tagging and crediting AR Interiors Inc.
  7. For the avoidance of doubt, where the provisions of any applicable law prohibit the extent to which certain activities can be restricted under this Clause 3, any such restrictions shall apply to the fullest extent permitted in accordance with such law.

 

LINKS TO OTHER WEBSITE

 

  1. We love supporting our partners and other businesses and to show our appreciation we occasionally link to their websites and services. When you click on one of these links, you are leaving AR Interiors Inc,  and these Terms of conditions no longer apply.  Links to third-party websites or services that are not owned or controlled by AR Interiors Inc.
  2. AR Interiors Inc has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services.
  3. You further acknowledge and agree that AR Interiors Inc shall not be held responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through such websites or services.
  4. We strongly advise that the terms and conditions and privacy policies of any third-party websites or services are carefully read prior to the user visiting.

 

TERMINATION

 

  1. We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. 
  2. All provisions of the Terms, which by their nature should survive termination, shall survive termination including, without limitation, ownership provisions warranty disclaimers, indemnity and limitations of liability. 
  3. We may terminate or suspend Service immediately, without prior notice or liability, for any reason whatsoever if you breach the Terms. 
  4. Upon termination, your right to use the Service will immediately cease. 
  5. You agree to defend, indemnify and hold harmless AR Interiors Inc and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liability, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of:
  6. your use and access of the Service, by you or any person using your Online Home Design.
  7. a breach of these Terms.

 

LIMITATIONS OF LIABILITY

In no event shall AR Interiors Inc, nor its directors, employees, partners, agents, suppliers or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:
  2. your access to or use of, or inability to access or use the Service;
  3. any conduct or content of any third-party on the Service;
  4. any content obtained from the Service; and
  5. unauthorized access, use or alteration of your transmissions or content, whether based on warrant, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

 

WARRANTY DISCLAIMER

 

  1. Your use of the Service is at your sole risk. 
  2. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. 
  3. The Service is provided without warranties of any kind, whether express or implied, including but not limited to:
  4. implied warranties of merchantability;
  5. fitness for a particular purpose;
  6. non-infringement; or
  7. course of performance.

 

INDEMNITY

 

  1. You agree to indemnify and hold us, our Representatives, licensors, and sub-contractors harmless against all costs, claims, damages, liability and expenses (including any professional fees) which might incur by reason of a breach by you of these Terms. 

 

EXCLUSIONS

 

  1. Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. 

 

GOVERNING LAW

 

  1. These Terms shall be governed and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
  2. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. 
  3. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. 
  4. These Terms constitute the entire agreement between us with respect to your access and use of the Service, and supersede and replace all prior agreements, negotiations and discussions we might have between us relating to the same.
